Pornhub Will Have to Disclose Its Users’ Details

A US federal court has ordered the adult website to disclose names, email addresses, IP addresses, and other identifying information of the users who upload pirated videos. The court issues the order following the request of a producer of adult content, who found over 1,000 infringing videos on Pornhub.

Pornhub is one of the largest websites on the Internet and mostly relies on user uploaded content. As a result, it often faces copyright infringement allegations. The company maintains a DMCA takedown policy, which allows copyright owners to remove their content. Besides, Pornhub reserves the right to terminate the accounts of repeat infringers.

Although porn production companies usually simply send takedown requests, this time the content creator decided to go one step further: the Seychelles-based producer wants to know who illegally uploaded its videos to Pornhub and has already obtained a DMCA subpoena from a federal court in California. So, Pornhub now has 4 weeks to hand over the requested details unless it decides to appeal.

It must be noted that the subpoena is quite broad and compels the service to hand over all the collected information on the uploaders, including names, email addresses, IP addresses, user histories and any other identifying or account information.

It is not clear what the adult content producer is going to do after obtaining the personal details of the infringers. Perhaps, if the evidence is sufficient, they will consider legal action against the uploaders. Industry experts admit that it is the first time that a copyright holder has used a DMCA subpoena to get information about Pornhub uploaders (but perhaps not the last one).
